Please read these Terms of Service ("Terms") carefully before using PremiumBid at premiumbid.net. By creating an account, purchasing a subscription or credits, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
PremiumBid is an AI-powered software platform that assists contractors, engineers, architects, and other professionals in drafting Statements of Qualifications (SOQs) and responses to Requests for Qualifications (RFQs). The platform uses large language model (LLM) technology provided by third-party AI providers to analyze uploaded documents and generate draft text.
PremiumBid is a productivity and drafting tool only. It is not a law firm, engineering firm, or professional consulting service. See Section 5 for the full AI Disclaimer.
Pay Per RFQ (Credits): Credits are purchased individually at $49 per credit. Each credit entitles you to one full pipeline run (RFQ extraction, scoring, SOQ generation, and validation). Credits do not expire and are non-transferable.
Pro Monthly Subscription: At $299 per month, billed automatically on a recurring basis through Stripe. Your subscription renews monthly until cancelled. You may cancel at any time from the billing portal; you retain access through the end of the current billing period. No prorated refunds are issued for partial months.
Payment Processing: All payments are processed by Stripe, Inc. By purchasing, you agree to Stripe's terms of service. PremiumBid does not store your credit card or banking information.
Taxes: Prices do not include applicable taxes. You are responsible for any sales, use, or similar taxes imposed on your purchase.
Price Changes: We reserve the right to change pricing at any time. Active subscribers will be given at least 30 days' notice before any price increase takes effect.
All sales are final. PremiumBid does not issue cash or credit card refunds.
If a pipeline run fails entirely due to a platform error and you believe a credit was incorrectly consumed, contact us at support@premiumbid.net within 7 days. We may, at our sole discretion, issue a replacement credit. Replacement credits are not guaranteed and are evaluated case by case.
AI-generated output quality (such as scoring, SOQ length, or writing style) does not constitute grounds for a refund or credit replacement, as API processing costs are incurred regardless of user satisfaction with the output.
Important: PremiumBid uses AI to draft documents. The quality, accuracy, and suitability of any output is not guaranteed. You are responsible for reviewing all generated content before use.

PremiumBid uses artificial intelligence — specifically large language models operated by third-party providers — to generate Statements of Qualifications and related bid response documents. By using the Service, you acknowledge and agree to all of the following:
You agree not to use the Service to:
Your content: You retain ownership of the RFQ documents, company information, and other content you upload or enter into the platform ("User Content"). By uploading User Content, you grant PremiumBid a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.
AI-generated output: Subject to these Terms, you own the AI-generated SOQ text produced from your inputs. You are responsible for how you use, modify, and submit that output.
Our platform: PremiumBid, its software, design, trade names, trademarks, and all associated intellectual property are owned by Patrick Ziobro / PremiumBid. You may not copy, reproduce, or create derivative works from any part of the platform.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.
The Service integrates with third-party providers including Stripe (payments), Supabase (data storage), and Anthropic (AI processing). These providers have their own terms of service and privacy policies. PremiumBid is not responsible for the practices or availability of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREMIUMBID AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO PREMIUMBID IN THE THREE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Patrick Ziobro, doing business as PremiumBid, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) any SOQ or document you submit to a third party using output from the Service; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases. Unused credits will be forfeited upon termination for cause. Provisions of these Terms that by their nature should survive termination (including Sections 5, 10, 11, 12, and 14) will survive.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any dispute arising from these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
Before initiating any legal proceeding, you agree to first contact us at support@premiumbid.net and attempt to resolve the dispute informally for at least 30 days.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. For material changes, we will notify active subscribers by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
